Terms of Use利用規約

These Terms of Use ("Terms") set forth the conditions for using "SpotSonic" (the "App"), an iOS application provided by japatabix (the "Developer"). By downloading or using the App, you agree to be bound by these Terms.

1. The App

The App is a location-based application that detects proximity to places (spots) you have registered and sends notifications. Features may be changed, added, or discontinued in the future.

2. Requirements

Using the App requires a compatible iOS device and appropriate permission settings such as location and notifications. Notification timing and accuracy may vary, and notifications may fail to arrive, depending on network conditions, device settings, and OS behavior and constraints.

3. Subscriptions

• The App offers auto-renewable subscriptions through Apple's App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions at any time in iOS Settings (Apple ID > Subscriptions).
• Refunds are handled in accordance with Apple's policies; the Developer cannot process individual refunds.

4. Prohibited Conduct

You must not:

• violate applicable laws or public order and morals;
• reverse engineer, decompile, or disassemble the App;
• interfere with the operation of the App;
• use the App in a manner that compromises safety, such as operating it while driving.

5. Intellectual Property

All copyrights and other intellectual property rights in the App and related content belong to the Developer or their rightful owners.

6. Disclaimer

• The App is provided "as is." The Developer makes no warranty as to its completeness, accuracy, usefulness, or fitness for a particular purpose.
• Location accuracy and notification delivery depend on GPS conditions, device power management, and OS behavior. The Developer is not liable for damages arising from missed, delayed, or inaccurate notifications.
• Except in cases of willful misconduct or gross negligence, the Developer shall not be liable for any damages arising from the use of, or inability to use, the App.

7. Changes to These Terms

The Developer may revise these Terms when necessary. Revised Terms take effect when posted on this page.

Controlling Language

These Terms and the Privacy Policy below are prepared in English and Japanese. In the event of any discrepancy between the two versions, the English version shall prevail.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Developer's place of business.

本利用規約(以下「本規約」)は、じゃぱたびっくす(以下「開発者」)が提供する iOS アプリケーション「SpotSonic」(以下「本アプリ」)の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなします。

第1条(本アプリの内容)

本アプリは、ユーザーが登録した地点(スポット)への接近を検知し、通知を送信する位置情報アプリです。機能の一部は今後変更・追加・終了されることがあります。

第2条(利用環境)

本アプリの利用には、対応する iOS 端末と、位置情報・通知等の権限設定が必要です。通信環境や端末設定、OS の仕様・制約により、通知の到達時刻や精度が変動し、または通知が到達しない場合があります。

第3条(サブスクリプション)

• 本アプリは、Apple の App Store を通じたサブスクリプション(自動更新購読)を提供します。
• 購読料金は購入確定時に Apple ID アカウントに課金されます。
• 購読は、期間終了の24時間前までに解約しない限り自動的に更新され、更新料金が課金されます。
• 購読の管理・解約は、iOS の設定(Apple ID > サブスクリプション)からいつでも行えます。
• 返金は Apple のポリシーに従います。開発者は個別の返金対応を行うことができません。

第4条(禁止事項)

ユーザーは、本アプリの利用にあたり、次の行為をしてはなりません。

• 法令または公序良俗に違反する行為
• 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル等の解析行為
• 本アプリの運営を妨害する行為
• 運転中の操作など、安全を損なう態様での利用

第5条(知的財産権)

本アプリおよび関連するコンテンツに関する著作権その他の知的財産権は、開発者または正当な権利者に帰属します。

第6条(免責事項)

• 本アプリは現状有姿で提供され、開発者はその完全性・正確性・有用性・特定目的への適合性を保証しません。
• 位置情報の精度および通知の到達は、GPS 環境・端末の省電力制御・OS の仕様等に依存します。通知の不達・遅延・誤差により生じた損害について、開発者は責任を負いません。
• 本アプリの利用または利用不能により生じた一切の損害について、開発者は、開発者に故意または重過失がある場合を除き、責任を負いません。

第7条(規約の変更)

開発者は、必要と判断した場合、本規約を変更できます。変更後の規約は、本ページに掲載した時点から効力を生じます。

正文

本規約および後記プライバシーポリシーは、英語および日本語で作成されます。両者の間に相違がある場合、英語版が優先します。

第8条(準拠法・裁判管轄)

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合、開発者の所在地を管轄する裁判所を専属的合意管轄とします。

Privacy Policyプライバシーポリシー

SpotSonic (the "App") is an iOS application provided by japatabix (the "Developer"). This policy describes how we handle your information.

1. No Account Required

The App does not require account registration. You never need to provide your name, email address, phone number, or any other personal information to the Developer.

2. Information We Collect

The App collects your device's location data to provide proximity notifications for registered spots. Location data is used only on your device for proximity detection calculations and is never transmitted to the Developer's servers or any third party (the Developer does not operate any external servers).

3. Purpose of Use

• Detecting proximity to your registered spots and sending notifications
• Obtaining addresses and place names for registered spots (using Apple CLGeocoder)

4. iCloud Data Sync

Your spot data and settings are stored in and synced to your own iCloud account via Apple's iCloud (CloudKit). This allows your data to carry over across your devices. Data in iCloud is managed under Apple's Privacy Policy, and the Developer cannot access its contents. You can turn off iCloud sync in iOS Settings.

5. Third-Party Sharing

The App does not use any third-party services such as advertising SDKs or analytics tools. Your information is never shared with third parties.

6. Data Storage and Deletion

Data is stored on your device (SwiftData / UserDefaults) and in your iCloud. Deleting the app removes the data stored on your device. Data in iCloud can be removed by deleting the App's iCloud data in iOS Settings.

7. Subscriptions (In-App Purchases)

The App offers subscription-based in-app purchases through Apple's StoreKit 2. Payment information is managed entirely by Apple; the Developer does not have access to credit card numbers or other payment details.

8. "Always Allow" Location Access

The App requires "Always Allow" location access to deliver proximity notifications while running in the background. Location data is used exclusively for proximity detection calculations and is never transmitted outside your device. You can change this permission at any time in iOS Settings.

SpotSonic(以下「本アプリ」)は、じゃぱたびっくす(以下「開発者」)が提供する iOS アプリケーションです。本アプリにおける個人情報の取り扱いについて、以下のとおり定めます。

1. アカウント登録について

本アプリの利用にあたり、アカウント登録は不要です。氏名・メールアドレス・電話番号等の個人情報を開発者に提供する必要は一切ありません。

2. 取得する情報

本アプリは、スポット近接通知機能のため、端末の位置情報を取得します。位置情報は近接検知の計算にのみ端末内で使用され、開発者のサーバーや第三者へ送信されることはありません(開発者は外部サーバーを運営していません)。

3. 情報の利用目的

• 登録スポットへの接近を検知し通知を送信するため
• 登録スポットの住所・地名を取得するため(Apple CLGeocoder 使用)

4. iCloud によるデータ同期

スポットデータ・設定情報等は、Apple の iCloud(CloudKit)を通じて、ユーザー自身の iCloud アカウントに保存・同期されます。これによりユーザーの複数端末間でデータが引き継がれます。iCloud 上のデータは Apple のプライバシーポリシーに基づき管理され、開発者がその内容にアクセスすることはできません。iCloud 同期は iOS の設定からオフにできます。

5. 第三者への提供

本アプリは、広告 SDK・アクセス解析ツール等の第三者サービスを一切利用しておらず、ユーザーの情報を第三者に提供することはありません。

6. データの保存と削除

データは端末内(SwiftData / UserDefaults)およびユーザーの iCloud に保存されます。アプリを削除すると端末内のデータは消去されます。iCloud 上のデータは、iOS の設定から本アプリの iCloud データを削除することで消去できます。

7. サブスクリプション(アプリ内課金)

本アプリは Apple の StoreKit 2 を使用したサブスクリプション課金機能を提供しています。課金情報は Apple が管理しており、開発者がクレジットカード番号等の決済情報にアクセスすることはありません。

8. 位置情報の「常に許可」について

本アプリはバックグラウンドでのスポット近接通知のため、位置情報の「常に許可」を必要とします。位置情報は近接検知の計算にのみ使用し、端末外に送信することはありません。この権限は iOS の設定からいつでも変更できます。
